Introduction
This Terms and Conditions Agreement (“Agreement”) governs the relationship between Workspace Philippines (“Platform”) and Guests/Users (“Users”) who book spaces listed on the Platform. By using the Platform to book spaces, Users agree to be bound by this Agreement and any applicable policies.
1. Definitions
- Platform: Workspace Philippines, an online marketplace where spaces are listed for rental purposes.
- Owner: The individual or entity that lists their space on the Platform.
- User/Guest: Individuals or businesses that book spaces through the Platform.
2. User Responsibilities
- Accurate Information: Users must provide accurate and complete information when creating an account, booking spaces, or communicating with Owners.
- Adherence to Rules: Users must follow all rules and guidelines set by Owners, including capacity limits and restrictions on prohibited activities.
- Respectful Conduct: Users must treat the Owner’s space with care and respect. Any damage caused during the booking period may result in additional charges.
- Compliance with Laws: Users are responsible for complying with all applicable laws and regulations while using a booked space.
3. Deposits
- Security Deposits: Owners may require a security deposit for bookings, which will be clearly stated in the listing. Workspace Philippines will return the deposit within 5-7 days after the scheduled booking, pending verification from Space Owners regarding any claims.
4. Booking and Payment
- Booking Requests: Users can request or instantly book spaces, depending on the Owner’s settings. A booking is confirmed only after successful payment.
- Payment Processing: Workspace Philippines processes payments and provides Users with booking confirmations. Accepted payment methods include credit/debit cards and other supported options.
- Cancellation and Refunds: Users must adhere to the cancellation policy outlined in the space listing. Refunds, if applicable, will follow Workspace Philippines’ standard refund policy or the Owner’s specified terms.
5. Fees
- Admin Fee: A 7.5% administrative fee will be added on top of the total booking amount. This fee helps support the ongoing maintenance and development of our platform, ensuring a seamless booking experience, secure transactions, and continuous improvements to our services.
- Other Fees: Owners are responsible for disclosing all additional fees. Workspace Philippines is not liable for any undeclared charges.
6. User Conduct and Prohibited Activities
- Prohibited Uses: Users may not engage in illegal activities, damage property, or use spaces for unauthorized purposes.
- Non-Interference: Users must not disrupt the Owner’s operations, neighbors, or other Users.
- No Subletting: Users may not transfer or sublet their booking without explicit consent from the Owner.
7. Liability and Indemnity
- User Responsibility: Users accept full responsibility for damages, injuries, or losses that occur while using a booked space. Disputes regarding damages must be resolved directly with the Owner.
- Indemnification: Users agree to indemnify and hold Workspace Philippines harmless from any claims, damages, or disputes arising from their use of a booked space.
- Limit of Liability: Workspace Philippines is not liable for indirect, incidental, or consequential damages, including lost opportunities or profits due to booking issues or disputes.
8. Dispute Resolution
- Dispute Handling: Disputes should be resolved directly between the Space Owner and the Guest. Workspace Philippines may assist by providing relevant booking information and data.
- Mediation: Workspace Philippines may offer mediation services but is not obligated to resolve disputes.
- Refund Requests: Refunds may only be requested within 24 hours of the scheduled booking. No refunds will be issued beyond this period.
9. Receipts and Invoices
- Users may request official receipts or invoices directly from the Space Owners.
10. Termination of Use
- Platform Rights: Workspace Philippines reserves the right to suspend or terminate a User’s account for violations of this Agreement, including fraudulent activities or repeated complaints.
- User Termination: Users may delete their account at any time but remain responsible for obligations related to existing bookings.
11. Amendments to the Agreement
Workspace Philippines reserves the right to modify or update these Terms and Conditions at any time. Significant changes will be communicated to Users, and continued use of the Platform constitutes acceptance of the revised Agreement.
12. Miscellaneous
- Entire Agreement: This Agreement represents the complete agreement between Workspace Philippines and the User.
- Severability: If any provision is deemed unenforceable, the remaining provisions remain valid.
- Assignment: Users may not transfer or assign their rights or obligations without written consent from Workspace Philippines.
Acceptance
By booking a space on Workspace Philippines, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
